TO: Ferrotherm Corporation Suppliers and Potential Suppliers
SUBJECT:
U.S. International Traffic in Arms Regulations (ITAR) Controlled
Material
As
a current or potential supplier to us, it is likely you may be
required to handle technical data as defined by International
Traffic in Arms Regulations (ITAR).
As
part of our supplier outreach program, we want to ensure that
you are aware of the requirements associated with these regulations.
Compliance with them is key to our successful partnering.
Please
be aware that technical data such as, documentation, software,
drawings, specifications, etc., that may be provided to you, is
subject to the export control laws of the United States Government.
Transfer
of this data by any means to a foreign person, whether in the
United States or abroad, without prior approval from the U.S.
Department of State, is strictly prohibited.
In
accordance with the Arms Export Control Act and pursuant to ITAR
Section 122.1, "Any person who engages in the United States
in the business of either manufacturing or exporting of defense
articles or furnishing defense services is required to register
with the U.S. Department of State Office of Defense Trade Controls.
Manufacturers
who do not engage in exporting must nevertheless register. Information
on registering with the Office of Defense Trade Controls is available
on-line at http: www.pmdtc.org/registration.htm.
The
ITAR requires that prior to Ferrotherm distributing any ITAR controlled
technical data (as defined in ITAR 120.10) for purchases of a
defense article (as defined in ITAR 120.6), Ferrotherm must require
a written confirmation from the recipient that he/she/it is a
U.S. Person (as defined in ITAR 120.15), and whether the recipient
is currently registered with the U.S. Department of State Office
of Defense Trade Controls.
